Notice of Public Hearing – January 25, 2022

For an amendment to the MD of Peace No. 135 West Hill Business Park Area Structure Plan and the Land Use Bylaw

 

Pursuant to the Municipal Government Act, being Chapter M-26 of the Statutes of Alberta, notice is hereby given that the Council of Municipal District (MD) of Peace No. 135 will hold public hearings on January 25, 2022 prior to the second reading of:

  1. Bylaw No. 6/2021 for an amendment to the West Hill Business Park Area Structure Plan 3/2009; and
  2. Bylaw No. 7/2021 for an amendment to the Land Use Bylaw No. 1/2012.

Background and Overview of Proposed Amendment Bylaws

In October 2021, the MD received an application to amend the West Hill Business Park Area Structure Plan No. 3/2009, to enable a proposed cardlock gas station at NW 28.83.22 W5M, within the West Hill Business Park Area. The proposed development cannot be allowed without an amendment to both the Area Structure Plan and the Land Use Bylaw. Council gave first reading to both Bylaws during its December 14, 2021 meeting.

Bylaw No. 6/2021

Bylaw No. 6/2021 proposes to amend a number of policies in the Area Structure Plan pertaining to access, servicing, development setbacks, and phasing of development. Bylaw No. 7/2021

Bylaw No. 7/2021 proposes to revise the requirements for site provisions, to allow the use of private water and sewer systems on a temporary basis for parcels located within the West Hill Business Park Area Structure Plan area, in the following Land Use Districts:

  • Rural Industrial District (RI)
  • Commercial Industrial District (CI)
  • Highway Commercial District (HC)
  • Service Commercial District (SC)

Public Hearing Procedures

Due to the current covid-19 situation, the public hearings will be held virtually via Zoom. The link to the Zoom meeting will be posted to the MD’s website and social media outlets prior to the meeting date.  The public hearing for Bylaw No. 6/2021 will be held at 6:00 p.m., followed by the public hearing for Bylaw No. 7/2021. At each public hearing, the bylaw will be presented and Council will hear any person or groups of persons acting on their behalf who claim to be affected by the proposed bylaw. Council may also hear any other person who wishes to make a presentation and whom Council agrees to hear. Per the MD’s Procedural Bylaw No. 11/2019, any person speaking to a bylaw may have up to 10 minutes to speak. You may also submit written feedback.

Written submissions received will be recognized prior to any oral submissions.
